Terms and Conditions
Last updated: 12 October 2026
These Terms and Conditions govern use of SociallyAustralia.com and, where expressly accepted as part of a booking, registration or campaign, participation in Socially Australia’s services and creator network.

“We”, “us” and “our” mean GF18 Holdings Group LTD trading as Socially Australia. “You” means the website user, brand, business, creator or influencer to whom the relevant provisions apply.
2. How these terms apply
The website-use provisions apply when you use our website. Service and campaign obligations apply when you accept them through a registration form, booking, written agreement or other clear acceptance process.
Visiting the website alone does not create a paid booking or an obligation to participate in a campaign.
Specific proposals, statements of work, campaign briefs and service agreements may contain additional terms. If there is a conflict, a signed service agreement takes priority, followed by an accepted proposal or campaign agreement, and then these terms.
Our Privacy Policy explains how we handle personal information. Acceptance of these terms does not replace any separate consent required by law.
3. Eligibility and authority
You must provide accurate information and have authority to enter into any agreement you accept.
If acting for a brand or business, you confirm that you are authorised to commit it to the relevant agreement.
Creators must be at least 18 to enter into campaign agreements independently. Participation by anyone under 18 requires an arrangement expressly agreed by us with an appropriately authorised parent or guardian.
4. Our services
Socially Australia connects brands with creators and influencers and provides services that may include:
- Influencer gifting.
- User-generated content creation.
- Paid creator collaborations.
- Campaign strategy, coordination and management.
- Social media content and posting services.
- Campaign tracking and reporting.
The services, quantities, fees, timelines and usage rights included in a booking will be set out in the accepted proposal or service agreement.
An enquiry, creator registration or introductory discussion does not guarantee a booking, campaign placement or commercial relationship.
5. Bookings and campaign scope
A booking is confirmed when both parties accept the relevant proposal or agreement and any required initial payment is received.
Before work begins, the agreed scope should identify relevant matters such as:
- Deliverables and campaign objectives.
- Creator selection criteria and approval arrangements.
- Product quantities and dispatch responsibilities.
- Content formats, deadlines and revision allowances.
- Fees, payment dates and additional costs.
- Content ownership and usage rights.
- Campaign duration and cancellation arrangements.
Material changes require written agreement. We will explain any resulting fee or timing changes before carrying out additional work.
6. Fees and payment
Fees, currency, applicable taxes and payment dates will be stated in the accepted proposal, agreement or invoice issued under that agreement.
Advertising spend, product costs, shipping, duties, paid creator fees and other third-party expenses are included only where expressly stated.
We will not incur additional chargeable expenses on your behalf without your approval.
If an undisputed payment is overdue, we may give written notice and a reasonable opportunity to pay before suspending affected services. Any suspension must be proportionate to the unpaid amount and its effect on delivery.
You remain responsible for properly due charges for completed work and authorised commitments. Suspension does not remove your rights concerning deficient or undelivered services.
Creators’ fees and payment arrangements are governed by their individual campaign agreements. Receiving a gift does not create an entitlement to a cash payment.
7. Brand responsibilities
Brands must:
- Provide accurate briefs, product information and approved claims.
- Supply products, assets, permissions and access reasonably needed for the work.
- Ensure supplied products comply with applicable safety, labelling and advertising requirements.
- Identify relevant restrictions, warnings, allergens and suitability considerations.
- Provide feedback and approvals within agreed timescales.
- Hold the rights needed for materials they ask us or creators to use.
- Handle creator information lawfully and securely.
- Notify us promptly of recalls, safety concerns or material product changes.
Brands are responsible for product fulfilment unless another arrangement is expressly agreed.
We may decline instructions or pause affected work if there is a reasonable concern about illegality, misleading claims, product safety or infringement of another person’s rights.
8. Creator and influencer responsibilities
Creators must:
- Provide accurate profile, audience, contact and delivery information.
- Disclose material inaccuracies, artificial audience activity or conflicts relevant to a campaign.
- Follow campaign requirements they have accepted.
- Meet agreed deadlines and communicate promptly about difficulties.
- Create original content or obtain the necessary permissions for third-party material.
- Present genuine experiences and avoid misleading statements.
- Make required advertising and commercial relationship disclosures.
- Follow applicable laws and platform rules.
- Keep confidential information secure.
Creators must not claim to have used a product when they have not, fabricate results or make unsupported product claims.
An accepted brief cannot require a creator to make a false statement or conceal a commercial relationship.
9. Influencer gifting and sharing details
By ticking “Yes” to gifting on a form that clearly explains these arrangements, you authorise us to share your full gifting and relevant creator profile details with participating brands for product gifting and campaign administration.
These details may include your full name, email address, telephone number, delivery address, delivery instructions, social media handles and relevant profile information.
While this permission remains current, we do not need further approval or acceptance from you before sharing those details with a participating brand or arranging an individual gift within the scope of your gifting preferences.
This does not authorise sharing bank details, identity documents, sensitive information or unrelated private communications for gifting purposes.
Brands may create a customer or recipient record in their ecommerce or fulfilment systems to dispatch gifted products. You may receive order confirmations, tracking information and other messages relating to delivery.
Brands may retain your email address and relevant records where reasonably necessary for gifting administration, campaign support and lawful recordkeeping, subject to their privacy policies and applicable law.
Your gifting selection does not automatically authorise unrelated marketing emails from a brand.
You can withdraw gifting permission or update your preferences by emailing jonathan@sociallyaustralia.com. Withdrawal stops future sharing based on that permission once processed, but does not reverse disclosures already made or automatically cancel products already dispatched.
Further information appears in our Privacy Policy.
10. Gifts and content obligations
Selecting “Yes” to gifting does not guarantee that you will receive products.
Unless a specific content obligation has been clearly disclosed and accepted separately, receiving an unsolicited gift does not oblige you to create content, publish a review or provide a positive endorsement.
Where a creator accepts a campaign requiring content in exchange for a product, the agreed deliverables and deadlines apply. Acceptance may occur through a campaign form or another clear acceptance process.
The permission to receive gifts and share delivery details is separate from acceptance of content obligations.
A product described as a gift will not carry a product charge unless you have separately and expressly agreed to a purchase.
11. Product delivery and safety
Creators must keep delivery details current and notify us promptly of missing, damaged or incorrect products.
Brands and their fulfilment providers are responsible for dispatch arrangements they manage. We will provide reasonable coordination support where included in our services.
Creators should read product labels, warnings and instructions and assess whether a product is suitable for them. A campaign brief does not override safety advice or require use of an unsuitable product.
If a product presents a safety concern, stop using it and notify the supplying brand and us.
Any return requirement, shipping charge or customs responsibility must be clearly disclosed and agreed in advance. Nothing in this section limits applicable statutory rights.
12. Advertising disclosures and accuracy
Brands and creators must comply with applicable advertising laws, industry requirements and platform policies.
Where content constitutes advertising or a commercial endorsement, its commercial nature must be clearly disclosed using an appropriate label, such as “Ad”, and relevant platform tools where required.
A reference to a product being “gifted” may not, by itself, satisfy every applicable advertising disclosure requirement.
Product claims must be accurate and supported where required. Particular care must be taken with health, nutrition, environmental and performance claims.
We may request correction or removal of campaign content where there is a reasonable compliance concern.
13. Campaign outcomes and deliverable guarantees
We will provide services with reasonable care and skill.
Unless expressly agreed in writing, we do not guarantee a particular level of sales, revenue, reach, impressions, engagement, follower growth or return on investment.
Forecasts and examples are estimates, rather than promises of future performance.
Any expressly agreed guarantee concerning content quantities, posts or other deliverables remains binding. If an agreed deliverable is not supplied, we will discuss an appropriate remedy, subject to the agreement and applicable law.
Product gifting without an accepted posting obligation cannot guarantee a post from every recipient.
14. Content review and revisions
Content approval procedures, revision allowances and deadlines will be set out in the relevant agreement.
Requests should be consistent with the accepted brief. Material changes to the brief or additional versions may require an agreed scope and fee adjustment.
If feedback or essential materials are delayed, we will explain the effect and agree reasonable revised timings where possible.
Silence does not automatically constitute content approval unless a specific, reasonable approval process has been expressly agreed.
15. Intellectual property and content usage
Our website branding, text, designs and other materials belong to us or our licensors. You may view and use them for ordinary website purposes, but must obtain permission for commercial reproduction or redistribution unless the law permits it.
Brands retain ownership of materials they supply. They grant us and relevant creators the permissions reasonably necessary to perform the agreed work.
Creators retain ownership of their original content unless an express written agreement provides otherwise.
A campaign agreement must specify the rights granted to a brand, including relevant platforms, duration, territory and permitted uses.
Paid advertising, partnership ads, account access, sublicensing, exclusivity, substantial editing and use of a creator’s likeness require the appropriate agreed permissions.
Receiving content or gifting a product does not automatically grant unlimited ownership or perpetual usage rights.
We will obtain appropriate permission before using confidential campaign materials or creator content in our own marketing.
16. Confidentiality
Each party must protect non-public information received in connection with a campaign, including unreleased products, private briefs, pricing, personal information and confidential business plans.
Confidential information may be disclosed to people who need it to deliver the work, subject to appropriate confidentiality obligations, or where disclosure is required by law.
This obligation does not apply to information already lawfully public, independently developed or lawfully received without restriction.
17. Website use
You must not:
- Use the website for unlawful, fraudulent or abusive purposes.
- Submit false information or impersonate another person.
- Attempt unauthorised access to systems, accounts or information.
- Introduce malware or interfere with website operation.
- Harvest personal information or creator details without permission.
- Copy or exploit protected materials without appropriate rights.
We may restrict access where reasonably necessary to address misuse, security risks or legal obligations.
We aim to keep the website available and accurate, but access may be interrupted for maintenance, technical issues or circumstances beyond our reasonable control.
18. Third-party platforms and services
Campaigns may rely on social media platforms, ecommerce systems, couriers and other third-party services.
Their own terms and policies apply. Platform changes, outages, moderation decisions or account restrictions can affect delivery and performance.
We are not responsible for independently operated third-party services merely because we link to or use them. We remain responsible for our own obligations and for reasonable care in work we undertake.
19. Cancellation and termination
Campaign duration, notice requirements and cancellation arrangements will be stated in the accepted agreement.
If no cancellation arrangement has been agreed, the parties will discuss a reasonable resolution based on completed work, remaining obligations and properly authorised costs that cannot reasonably be recovered.
Cancellation charges must reflect a reasonable basis and must not operate as a penalty.
Either party may terminate an affected agreement for a material breach that is not remedied within a reasonable period after written notice. Immediate suspension or termination may be appropriate for serious illegality, fraud, safety risks or a breach that cannot be remedied.
If we cancel a service without a breach by you or another lawful justification, we will refund fees for services not supplied and deal fairly with any outstanding deliverables.
Creators may leave our network at any time by contacting us. Leaving does not automatically cancel an existing campaign agreement, which must be addressed under its terms.
20. Refunds and statutory rights
Refunds and other remedies depend on the relevant agreement, the work supplied and applicable law.
Nothing in these terms excludes, restricts or modifies consumer guarantees or other rights that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
Where a service fails to meet an applicable statutory guarantee, you retain the remedies provided by law.
21. Liability
Each party is responsible for loss caused by its breach, negligence or unlawful conduct, subject to applicable law.
Neither party is responsible for losses that were not reasonably foreseeable when the relevant agreement was made.
We do not exclude liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited.
Any campaign-specific liability limit must be expressly agreed, lawful and reasonable. These website terms do not impose a blanket exclusion of responsibility for the services we supply.
22. Events beyond reasonable control
If an event beyond a party’s reasonable control prevents or materially delays performance, that party must notify the other promptly and take reasonable steps to reduce its effects.
The parties will discuss revised timelines, alternative delivery or cancellation where appropriate.
This provision does not automatically permit retention of fees for services never supplied or remove statutory rights.
23. Complaints and disputes
Please send complaints to jonathan@sociallyaustralia.com, explaining the issue and the outcome you are seeking.
We will investigate and aim to respond substantively within 30 days. If further time is needed, we will explain why.
Where possible, the parties should first attempt to resolve a dispute through good-faith discussion. Mediation may be used by mutual agreement.
This process does not prevent urgent legal action or access to statutory complaint and dispute-resolution rights.
24. Governing law
Subject to mandatory laws that apply to you, these terms are governed by the laws of England and Wales.
Nothing in these terms removes protections under Australian Consumer Law or other mandatory Australian laws where they apply.
The courts of England and Wales have non-exclusive jurisdiction. This does not prevent proceedings in another court with lawful jurisdiction or restrict any right to use local courts that cannot lawfully be restricted.
A separate service agreement may expressly provide a different governing law or jurisdiction.
25. Changes to these terms
We may update these terms for future website use, registrations and bookings. The current version will be published on this page with its updated date.
Changes will not retrospectively alter an existing campaign or service agreement without the parties’ agreement, except where required by law.
Where a material change requires your acceptance, we will seek it before applying the change.
26. General provisions
If a provision is found unenforceable, the remaining provisions continue to apply to the extent legally possible.
A failure or delay in enforcing a provision does not automatically waive the right to enforce it later.
These terms do not create employment, a partnership or authority for a creator or brand to bind us. The legal status of any working relationship depends on its actual circumstances and applicable law.
